1. Terms

   By accessing WinItLocal’s website or mobile app, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site or mobile app. The materials contained herein are protected by applicable copyright and trademark law.

2. Prize Giveaway Rules

   By using WinItLocal.com or its mobile apps, you will agree to the following conditions:

   1. Users (also referred to herein as Users and Entrants) must be at least 18 years of age. By registering and/or entering, you certify that you have read and agree to the Terms of Service and the Privacy Policy.
   2. Users must provide valid and truthful information during all stages of use
   3. Users must not create more than one registered account per person, nor may they enter to win the same prize more than once per giveaway period.
   4. Users can only enter to win prizes for the locations in which they are currently residing, currently employed, or have visited within the past 90 days. Only US residents may participate. Any other Entrants will be disqualified.
   5. Users must not use a proxy or otherwise attempt to mask or reroute his/her internet connection.
   6. Users must not use a temporary or disposable email service.
   7. Employees and prize sponsors of WinItLocal.com, including their immediate families, are not eligible to participate in any of the prize giveaways.
   8. All User accounts and entries must be non-automated. Any entries submitted using an automated script, bot, or other form of bulk entry system will be disqualified.
   9. Prizes are provided directly by the sponsors identified with each giveaway offer. WinItLocal.com is not responsible for any sponsor’s failure to deliver a prize, or for any prizes that are lost or stolen during delivery.
   10. There is no purchase necessary to enter or to win. Unless otherwise stated on the prize entry form, all prizes will be either available for pick-up at the sponsor’s address, or will be provided or delivered by the sponsor within the sponsor’s local service or delivery area.
   11. Any prize warranties are provided solely by the prize sponsor and/or the manufacturer. Any disputes, legal claims, or otherwise regarding a prize's use, value, or warranty must be handled directly with the prize sponsor. WinItLocal.com does not provide any warranty, service, or support for prizes awarded.
   12. Accounts and prizes awarded may not be transferred, exchanged, sold, or otherwise change ownership under any circumstances, except as authorized by WinItLocal.com.
   13. Prize winners are responsible for any applicable taxes.
   14. WinItLocal.com does not offer exchanges, replacements or cash value for prizes.
   15. All winners are chosen at random. The odds of winning a prize depend on the number of entries received for each prize giveaway.
   16. WinItLocal.com reserves the right to close your account, deny access to our site, and/or disqualify anyone who violates our terms of service.
   17. Winners will be notified in-writing by WinItLocal with instructions on how to claim any prize(s) won. None of our prize awards require you to make a purchase or pay a fee of any kind. Winners' names and general locations may also be announced on our website and/or through social media sites such as Facebook. Prize sponsors will require appropriate identification when claiming any prize(s) won. To obtain a copy of the winner's name for a particular prize, or a copy of our Terms of Use and Privacy Policies, please mail your request along with a self-addressed, stamped envelope to: WinItLocal, PO Box 134, Johnson City, NY 13790. Note: For prize winner requests, please include the name of the prize and the market in which it was offered. Only one request per envelope please.

3. Disclaimer

   The materials and prizes on WinItLocal's website and mobile apps are provided "as is." WinitLocal makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, WinItLocal does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website, mobile apps, or otherwise relating to such materials or on any sites linked to WinItLocal. WinItLocal is not responsible or liable for any result that may arise from the use of this website or mobile apps (or inability to use its website or mobile apps for any reason), nor is it responsible for any technical or typographical errors whether mechanical, human, or otherwise, or for any errors resulting from the use of 3rd party products and services listed.

   All prize sponsors are clearly identified on the WinItLocal website and mobile apps. Use of a particular web browser, computer, or mobile device for the purpose of accessing WinItLocal should not in any way be taken as a representation that the makers or publishers of those computers, browsers, or devices are affiliated with, or sponsors of, WinItLocal. For example, by accessing WinItLocal through Apple's mobile app, you explicitly understand that Apple is not a prize sponsor.

   WinItLocal may at any time, for any reason, cancel or modify a prize offering including, but not limited to, the time frame of permitted entry and/or the prize itself. WinItLocal and its sponsors also reserve the right to substitute any listed prize (or prizes) with a prize of similar value.

4. Limitations

   In no event shall WinItLocal or its advertisers and sponsors be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on WinItLocal’s website or mobile apps, even if WinItLocal or a WinItLocal authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata

   The materials appearing on WinItLocal’s website or mobile apps could include technical, typographical, or photographic errors. WinItLocal does not warrant that any of the materials on its website are accurate, complete, or current. WinItLocal may make changes to the materials contained on its website at any time without notice. WinItLocal does not, however, make any commitment to update the materials.

   WinItLocal has not reviewed all of the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by WinItLocal of the site. Use of any such linked website is at the user's own risk.

   WinItLocal may revise these terms of use for its web site at any time without notice. By using this website or mobile app, you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

   Any claim relating to WinItLocal's website or mobile apps shall be governed by the laws of the State of New York without regard to its conflict of law provisions.

9. Account Termination

   WinItLocal may at any time terminate any user account for any reason without prior notice. Some reasons for termination include, but are not limited to:

   1. Any user found violating any terms set forth in the Terms of Service.
   2. Any user found cheating or exploiting WinItLocal in any way, shape or form.
   3. Any users using fake information on WinItLocal or on advertiser's offers
   4. Any users using multiple accounts.
